The UK postpones post-Brexit requirements for UKCA marking

In the aftermath of Brexit, approval for the UK equivalent of CE-marking (the UKCA approval) was supposed to go into effect on January 1, 2022. It has however been postponed by the UK Government until January 1, 2023.

The transition to the new and mandatory product marking for products being placed on the Great Britain (England, Wales and Scotland) market, UKCA (UK Conformity Assessed), has been extended by another year. The requirement for compliance with UKCA rules and labeling will therefore not take effect until 1 January 2023.

Meanwhile, CE-marked products that meet EU requirements can continue to be placed on the UK market (where EU and UK requirements match). This includes products which have been assessed and accepted by a designated European Notified Body (NB). At Scanreco we work with, among others, Nemko, that are also appointed UK Approved Body. We are already dealing with the approval process and which rules apply, as well as to make sure our products comply with the coming requirements set by the UK Government as soon as possible.

When the UKCA goes into effect, the new UKCA marking must be used for placing safety regulated, and other products that currently requires the CE marking, on the UK market.

Products that were placed on the UK, EU or EAA market prior to January 1, 2021, can continue to circle the market until they reach their end user and do not need to comply with the UKCA. A product is ‘placed on the market’ “when a written or verbal agreement (or offer of agreement) to transfer ownership or possession or other property rights in the product is exchanged” (more on this on the UK Gov. website).
